    NOTICE of WAITSFIELD PLANNING COMMISSION PUBLIC HEARINGS
    To Consider Proposed Amendments
    To The Waitsfield Zoning Bylaws
    Tuesday, February 16, 2010, 7:15 and 7:30 p.m.

    Limited Business District

    The Waitsfield Planning Commission will hold a public hearing on February 16, 2010, 7:15 pm, at the Waitsfield Town Office to receive comments on a proposed amendment to the Waitsfield Zoning Bylaw to add "Mixed Use" as a conditional use within the Limited Business (LB) District under Table 2.05 of the Waitsfield Zoning Bylaw.  The proposed amendment may affect property owners, businesses and residents within the Limited Business District, as shown on the Official Waitsfield Zoning Map.

    The purpose of the proposed amendment is to provide additional options for the use of properties within the district by allowing a mix of uses within a single structure or on a single lot.  A mixed use would be subject to conditional review and approval under Section 5.03 (Conditional Use Review) and Section 4.07 (Mixed Uses) of the bylaw.  The proposed amendment will not affect the types or densities of development currently allowed within the district, or planned community facilities and services that serve the district.

    Flood & Fluvial Erosion Hazard Areas
    The Waitsfield Planning Commission will hold a public hearing on February 16, 2010, 7:30 pm, at the Waitsfield Town Office to receive comments on proposed flood and fluvial erosion hazard area amendments to the Waitsfield Zoning Bylaw.  Proposed amendments will affect all property owners located in existing and proposed Flood and Fluvial Erosion Hazard Area Overlay Districts, as shown on accompanying Flood Insurance Rate Maps and Fluvial Erosion Hazard Area maps for the Town of Waitsfield.

    Proposed flood hazard area bylaw amendments include substantive changes under the existing Flood Hazard Area Overlay District (Table 2.10), related development review standards (Section 5.03.E) and updated definitions (Section 7.03), as well as minor changes under other sections of the regulations.

    Proposed fluvial erosion hazard area bylaw amendments include a new Fluvial Erosion Hazard Area Overlay District (Table 2.11), related development review standards (Section 5.03.F) and definitions (Section 7.03), as well as cross-references under other sections of the regulations.

    The general purposes of proposed amendments are to:
    1. Manage flood and fluvial erosion hazard areas in conformance with adopted municipal plans;
    2. Promote public health safety and welfare, by limiting new development and associated risks within mapped hazard areas;
    3. Limit losses due to flooding and streambank erosion;
    4. Preserve the flood carrying capacity and natural equilibrium of rivers and streams; and
    5. Ensure that the town and affected property owners can obtain federal flood insurance, hazard mitigation and disaster recovery funds through community participation in the National Flood Insurance Program.
